Effective Date: 1st April, 2026

This Cookie Policy (“Policy”) governs the use of cookies and similar tracking technologies by LaCharme LLC, a Florida limited liability company doing business as Health & Virtuals (“H&V,” “Company,” “we,” “us,” or “our”), in connection with:

  • all associated subdomains, portals, applications, systems, integrations, and services (collectively, the “Platform”).

This Policy forms an integral part of, and shall be read in conjunction with, the Privacy Policy and Terms and Conditions of Use.

By accessing or using the Platform, you acknowledge and agree to the use of cookies and tracking technologies as described herein.

1. DEFINITIONS AND SCOPE

For the purposes of this Policy, “Cookies” shall mean small data files stored on a User’s device which enable recognition of such device and facilitate storage or retrieval of information. “Tracking Technologies” shall include cookies, pixels, web beacons, scripts, tags, local storage objects, and other similar technologies capable of collecting or accessing data.

To the extent that any information collected through such technologies constitutes personal data under applicable law, such data shall be processed in accordance with the Privacy Policy.

This Policy applies across the entirety of the Platform, including all subdomains, integrated systems, and user interaction points.

2. PURPOSES OF PROCESSING THROUGH COOKIES

The Company utilizes cookies strictly for defined, legitimate, and proportionate purposes necessary for the operation and optimization of the Platform, including ensuring system functionality, maintaining session integrity, facilitating application workflows, enabling security controls, preventing fraudulent or unauthorized activity, analyzing usage patterns, and improving system performance and user experience.

Cookies shall not be deployed for purposes materially inconsistent with those described herein.

3. CATEGORIES OF COOKIES

Cookies deployed by the Platform include strictly necessary cookies required for core functionality and security, functional cookies enabling system preferences and continuity, analytical and performance cookies used to assess system efficiency and interaction behavior, and, where applicable, tracking or engagement cookies used for internal analytics and communication effectiveness.

Strictly necessary cookies are deployed on the basis of legitimate interest and do not require consent where permitted by law. All other categories of cookies shall be subject to applicable consent requirements.

4. THIRD-PARTY TECHNOLOGIES AND INTEGRATIONS

The Platform may incorporate third-party systems, services, and integrations that independently deploy cookies or tracking technologies. Such third parties may include infrastructure providers, analytics services, assessment platforms, and communication tools.

While the Company exercises reasonable diligence in the selection of such providers, it does not control the operation of third-party cookies and shall not be responsible for their independent data practices. Users acknowledge that such third parties may process data in accordance with their own policies.

5. LEGAL BASIS AND CONSENT

Where required under applicable laws, including the General Data Protection Regulation (GDPR) and ePrivacy Directive, non-essential cookies shall only be deployed following the User’s prior, explicit, and informed consent.

Such consent must be freely given, specific, informed, and unambiguous, and may be withdrawn at any time without affecting the lawfulness of prior processing.

Strictly necessary cookies may be deployed without consent where legally permissible.

6. COOKIE CONSENT MECHANISM

Upon initial access to the Platform, Users shall be presented with a consent mechanism enabling acceptance, rejection, or customization of cookie preferences.

The Company may maintain records of consent for compliance and evidentiary purposes.

Users may modify or withdraw consent at any time through available preference management tools.

7. COOKIE DURATION AND STORAGE

Cookies may be session-based, terminating upon closure of a browsing session, or persistent, remaining stored until expiration or manual deletion. Retention periods shall be limited to what is reasonably necessary for the intended purpose.

8. USER CONTROL AND DEVICE SETTINGS

Users may control or restrict cookies through Platform-provided mechanisms, browser settings, or third-party tools. Disabling certain cookies may impair functionality or limit access to certain features.

The Platform does not guarantee compatibility with all browser-level controls or third-party opt-out mechanisms.

9. DATA COLLECTED THROUGH TRACKING TECHNOLOGIES

Tracking technologies may collect technical and usage data, including IP address, device identifiers, session data, navigation patterns, and interaction behavior. Where such data is capable of identifying a User, it shall be treated as personal data.

10. CROSS-SYSTEM AND SUBDOMAIN FUNCTIONALITY

Due to the integrated nature of the Platform, cookies may operate across multiple subdomains and systems to maintain continuity of application processes, preserve session state, and enable seamless user experience across workflows.

Such cross-domain operation is necessary for the proper functioning of the Platform.

11. INTERNATIONAL DATA TRANSFERS

Data collected through cookies may be transferred across jurisdictions, including outside the European Economic Area. Where required, appropriate safeguards, including Standard Contractual Clauses or equivalent mechanisms, shall be implemented.

12. SECURITY AND INTEGRITY

The Company implements reasonable technical and organizational safeguards to protect data collected through cookies; however, no system can be guaranteed to be completely secure, and Users acknowledge the inherent risks associated with electronic data transmission.

13. DO NOT TRACK AND SIGNALS

The Platform does not currently respond to “Do Not Track” signals or similar browser-based mechanisms where no universally accepted standard exists.

14. REGULATORY COMPLIANCE AND CHANGES

The Company reserves the right to update its cookie practices in response to evolving legal, technical, or operational requirements. Continued use of the Platform constitutes acceptance of any updated Policy.

15. GOVERNING LAW

This Policy shall be governed by the laws of the State of Florida, United States.
